The content on the Site (‘the Content’) is owned or licensed by Pro-TP.
All copyright, trademarks, database right and other intellectual property rights in the Content are owned by Pro-TP or its licensors.
Except as expressly set out, nothing in General Terms and Conditions Pro-TP confers any license or other right in relation to the Content.
You may retrieve and view the Content on-screen and print out on paper (but not a photocopy) or store in electronic format (but not on any server or other device connected to a network) a reasonable amount of the Content for your personal and non-commercial use only. You shall not modify, copy, distribute, transmit, display, perform, reproduce, publish, license or create derivative works from the Content.
You acknowledge that Pro-TP and the Site are trademarks. You must not use them without the prior written permission of Pro-TP. No license is granted to you in General Terms and Conditions Pro-TP to use any trademark of Pro-TP.
Linking and Framing
You may hyperlink to the Site provide you hyperlink to the homepage in a new browser window. You may not deep-link to the Site (i.e. hyperlink to a page other than the Site homepage).
You may not frame any page of the Site (i.e. reproduce any page of the Site, including the homepage, framed within another website).
The Site may contain hyperlinks to websites provided by parties other than Pro-TP. Pro-TP is not responsible for the availability or content of third party sites. Hyperlinks to third party sites, including those posed by users, are provided as a convenience to you and are not an endorsement, authorization, sponsorship, affiliation or publication by Pro-TP of the Site, the post, its owners of providers.
You are responsible to Pro-TP for all losses, liabilities, costs, and expenses, reasonably suffered or incurred by Pro-TP under any judgment by a court of competent jurisdiction and all settlement sums paid by Pro-TP because of:
- any claim by a third party that your use of the Site is defamatory, offensive or abusive, or of an obscene or pornographic nature, or is illegal or constitutes a breach of any applicable law, regulation or code of practice;
- any claim by any third party that your use of the Site infringes that third party’s copyright or other intellectual property rights of whatever nature;
- any fines or penalties imposed by any regulatory, advertising or trading body or authority in connection with your use of the Site.
The Site is provided by Pro-TP without any warranties. Pro-TP(to the fullest extent allowed by law) disclaims all warranties, conditions or duties of every nature, including (without limitation) any implied warranties of satisfactory quality or fitness for a particular purpose, any express or statutory warranties and any warranties or duties regarding accuracy, timeliness, completeness or performance.
Pro-TP makes no warranty that the services rendered by the members of the network will be performed in accordance with the expectations of the clients.
Pro-TP makes no warranty that the Site is free from infection by viruses, Trojan horses or worms or anything else that has contaminating or destructive properties.
You agree that Pro-TP cannot be held responsible for the execution of the services rendered by members of the network. Users of Pro-TP are liable for their own proceedings and the, whether or not, decent fulfillment of those proceedings.
You agree that (to the fullest extent allowed by law) Pro-TP will not be liable to you and/or any third party for any consequential or incidental damages (including but not limited to loss of revenue, loss of profits, loss of anticipated savings, wasted expenditure, loss of privacy and loss of data) or any other indirect, special or punitive damages whatsoever that arise out of or are related to the Site.
The Site may contain materials posted by others. Users are responsible for ensuring they comply with the General Terms and Conditions Pro-TP. Pro-TP will not be responsible to you for any breach of General Terms and Conditions Pro-TP by another user.
If Pro-TP is liable for damages to persons or property, or if in the course of an assignment an event occurs that could lead to any liability on the part of Pro-TP, such liability is limited to the amount that is paid out in that specific case under the insurance of Pro-TP, increased by the amount of the applicable deductible (eigen risico).
You may not use the Site to;
- disseminate any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material;
- make, transmit or store electronic copies of materials protected by copyright without the permission of Pro-TP;
- interfere with any other person’s use of the Site.
There are risks I using information on the internet and you should make sure that you completely understand the risks before relying on any information or purchasing any items on the internet. It is your responsibility to verify information before relying on it and you must bear the risks associated with using the internet.
Pro-TP may update general terms and conditions of Pro-TP at time and your continued use of the Site after any update indicates your agreement to the updated General Terms and Conditions Pro-TP. General Terms and Conditions Pro-TP was last updated on the date appearing at the bottom of the page.
You may not assign, sub-license or otherwise transfer any of your rights under General Terms and Conditions Pro-TP.
The legal relationship between Pro-TP and the user, as well as between Pro-TP and all those that make use of Pro-TP’s services, is exclusively subject to Dutch law. Disputes shall be settled exclusively by the court that has jurisdiction in Amsterdam.
For the exclusive benefit of Pro-TP, Pro-TP retains the right to bring proceedings as to the substance of the matter in the courts of the country of your residence or your principal place of business.
If any court of competent jurisdiction finds any provision of general terms and conditions of Pro-TP invalid, the invalidity of that provision will not affect the validity of the remaining provisions which shall remain in effect.
Failure by Pro-TP to exercise any right or remedy under these terms does not constitute a waiver of that right or remedy.
Pro-TP shall not be responsible for any breach of general terms and conditions of Pro-TP caused by circumstances beyond its control.
